Your rights under CROA

You have the right to dispute inaccurate information in your credit report by contacting the credit bureau directly. However, neither you nor a credit repair organization has the right to have accurate, current and verifiable information removed. The credit bureau must remove accurate negative information only after the reporting period expires: generally seven years for late payments and collection entries and ten years for bankruptcy.
1. Right to dispute on your own
Everything a credit repair organization does, you have the right to do yourself and for free. The credit bureau must accept your dispute, investigate within a reasonable time (usually 30 days) and correct or delete an entry the source did not verify. The bureau notifies you of the result in writing and sends an updated report if anything in it changed. If the dispute is not resolved, you have the right to add a brief statement of your position to the report.
Credit bureaus must follow reasonable procedures to ensure the accuracy of information. They may decline to investigate only a clearly frivolous dispute.
2. Right to a copy of your credit report
You have the right to obtain a copy of your credit report from any bureau. The bureau may charge a reasonable fee but must provide the report free of charge if within the last 60 days you were denied credit, employment or insurance based on that report, if you are unemployed and intend to look for a job within 60 days, if you receive public assistance, or if the report contains inaccuracies due to fraud.
3. Right to cancel the contract
You have the right to cancel a contract with a credit repair organization for any reason within three business days from the date of signing, without penalty and without giving a reason. If the law of your state provides a longer period, the longer period applies. A cancellation notice form is attached to every Excalibur Credit Solutions contract; it is enough to send it to the company's e-mail or to your manager.
4. What a credit repair organization must and may not do
- May not charge you before the service has actually been performed. We invoice only for completed work.
- Must enter into a written contract with a precise description of services, timelines and cost, and give you a copy.
- May not require you to waive your rights under CROA. Any such waiver is void.
- May not make false or misleading statements to credit bureaus and creditors.
- May not advise you to change your identity, use a different number (a CPN or an EIN instead of your SSN) or otherwise hide your credit history.
- May not promise to remove accurate information or a specific credit score.
5. Right to sue
You have the right to sue a credit repair organization that violates the Credit Repair Organizations Act. Credit repair organizations are regulated by the Federal Trade Commission.
